Исследована одна из наиболее востребованных правоприменительной практикой статей главы 22 Уголовного кодекса РФ — незаконная банковская деятельность (ст. 172). Рассмотрены проблемы определения объекта преступления, приведен анализ основополагающих теоретических позиций, сформировавшихся в науке уголовного права, рассмотрены определяющие положения специального законодательства о банках и банковской деятельности в Российской Федерации, выделены признаки банковской деятельности как особого вида предпринимательской деятельности для целей применения норм уголовного права. На основе проведенного анализа разработано авторское определение понятия основного непосредственного объекта преступления, а также изучены признаки дополнительного объекта незаконной банковской деятельности, предложено определение дополнительного объекта преступления. Исследован вопрос о значении для квалификации в правоприменительной практике четкого, системного определения объекта преступления. Приведены основные теоретические положения, позволяющие отграничивать преступление, предусмотренное ст. 172 Уголовного кодекса РФ, от смежных составов, в первую очередь от состава незаконной предпринимательской деятельности, а равно от различных форм мошенничества.DOI 10.14258/izvasu(2018)3-14 ; The article is devoted one of the most highly demanded by law enforcement practice articles of chapter 22 of the Criminal Code of the Russian Federation — illegal banking activity (Article 172). The author considers the problems of determining the object of crime, analyzes the fundamental theoretical positions that have been formed in the science of criminal law, examines the defining provisions of the special legislation on banks and banking in the Russian Federation, identifies signs of banking as a special type of entrepreneurial activity for the purposes of applying criminal law. On the basis of the analysis, the author develops the definition for the concept of the main direct object of the crime, studies the signs of an additional object of illegal banking activity, and proposes the definition of an additional object of crime. The research is done of the importance for the qualification in law enforcement practice of a clear, systematic definition of the object of crime. The article proposes the main theoretical provisions that allow us to delimit the crime provided for by Art. 172 of the Criminal Code of the Russian Federation from adj acent components of crime, primarily from the illegal business activities and from various forms of fraud.DOI 10.14258/izvasu(2018)3-14

Рассматривается история законодательного закрепления причинения вреда при задержании лица, совершившего преступление, как обстоятельства, исключающего преступность деяния. Проведен анализ нормативно-правовых источников и постановлений пленумов Верховного Суда СССР и РФ. Показана роль разъяснений пленумов Верховного Суда СССР 1969 и 1984 гг. (посвященных вопросам необходимой обороны) в устранении частичных пробелов в регулировании этого обстоятельства Указом Президиума Верховного Совета СССР от 16 мая 1966 г. «Об усилении ответственности за хулиганство», затем Указом ПВС СССР от 1981 г. Определено значение Постановления Пленума Верховного Суда РФ от 27 декабря 2012 г. «О применении судами законодательства о необходимой обороне и причинении вреда при задержании лица, совершившего преступление» в устранении регулятивной недостаточности уголовно-правовой нормы, предусмотренной ст. 38 УК РФ, путем конкретизации ее содержания и, таким образом, обеспечение единообразия судебной практики в Российской Федерации. На основе анализа разъяснений пленума Верховного Суда РФ и зарубежного законодательства предложен вариант изменения редакция ч. 2 ст. 38 УК РФ.DOI 10.14258/izvasu(2018)3-19 ; The article deals with the history of the legislative fixation of the infliction of the harm while detaining a person who committed a crime as a circumstance excluding the criminality of the deed. The legal sources and Resolutions of the Plenum of the Supreme Court of the USSR and the Russian Federation are analyzed. The role of the explanations of the Plenum of the Supreme Court of the USSR of 1969 and 1984, which are devoted to the issues of the necessary defense, in the elimination of partial gaps in the regulation of this circumstance by the Decree of the Presidium of the Supreme Soviet of the USSR of May 16, 1966 «On Increasing the Liability for Hooliganism», and then by the Decree of the Plenum of the Supreme Court of the USSR of 1981 is shown. The importance of the resolution of the Plenum of the Supreme Court of the Russian Federation of December 27, 2012 "On the application of Legislation by Courts on the Necessary Defense and Infliction of Harm While Detaining a Person Who committed a crime" in the elimination of the regulatory insufficiency of the criminal law provision envisaged by Art. 38 of the Criminal Code of the Russian Federation by specifying its content and thus ensuring the uniformity in judicial practice in the Russian Federation is highlighted. Based on the analysis of the explanations of the Plenum of the Supreme Court of the Russian Federation and of the foreign legislation a version of alteration to Part 2 of Art. 38 of the Criminal Code of the Russian Federation is proposed.DOI 10.14258/izvasu(2018)3-19
